Annual Garden Maintenance Package Terms & Conditions 1. Binding Agreement 1.1 These Terms & Conditions form a legally binding agreement between the company and the customer upon acceptance. 1.2 Acceptance occurs upon sign-up, payment of any amount, or commencement of any service, whichever happens first. 1.3 Verbal, email, or written acceptance is sufficient to create a binding contract. 2. Scope of Services 2.1 The Package includes: • General garden maintenance at the agreed frequency (fortnightly or monthly) • Two (2) jet washing services per contract year • One (1) gutter cleaning service per contract year 2.2 The exact tasks, areas, access points, and service specifications are defined by the company’s assessment and quotation. 2.3 The company retains discretion over the method, timing, and execution of all services. 3. Pricing Structure 3.1 Each service and visit is priced individually based on site conditions at the time of quotation. 3.2 The total annual value is divided into 12 equal monthly payments for customer convenience. 3.3 Monthly payments do not reflect the number of visits in that month and are not visit-based charges. 3.4 The customer acknowledges the monthly fee is a payment plan, not a pay-pervisit arrangement. 4. Contract Term 4.1 The contract runs from the month of sign-up until 31st March of the following year. 4.2 The minimum contract term is fixed and non-cancellable, subject only to Section 5. 4.3 The contract automatically expires on 31st March unless renewed in writing. 5. Cancellation & Termination 5.1 Pre-Service Cancellation • Cancellation is permitted only if no services or visits have been completed. • Once any visit has taken place, the contract is deemed active and irrevocable. 5.2 Post-Service Cancellation • If the customer cancels after one or more visits: o All completed visits are chargeable at their full individual service price o Any outstanding balance becomes immediately due • Monthly payments already made will be offset against completed services. 5.3 No Refunds • No refunds are provided for: o Unused visits o Missed visits o Seasonal variations o Services scheduled but not yet delivered 6. Payment Terms 6.1 All payments are due monthly in advance. 6.2 Failure to pay results in immediate suspension of services without notice. 6.3 Services will not resume until all outstanding amounts are cleared. 6.4 Suspended or missed visits due to non-payment remain chargeable and do not reduce the contract value. 7. Scheduling & Operational Control 7.1 All visit dates are scheduled solely at the company’s discretion. 7.2 Exact dates and times are not guaranteed. 7.3 Service frequency is honoured over the contract term, not on a strict calendar basis. 7.4 Jet washing and gutter cleaning may be scheduled at any point deemed appropriate during the contract year. 8. Access & Missed Visits 8.1 The customer must ensure unrestricted access to all service areas. 8.2 If access is not available: • The visit may be skipped • The visit is considered delivered for charging purposes 8.3 Pets must be secured prior to all visits. 9. Site Condition & Variations 9.1 Pricing assumes the site remains in a maintainable condition. 9.2 If conditions deteriorate due to: • Missed visits • Restricted access • Customer request the company may: • Apply additional charges, or • Adjust the service scope accordingly 10. Waste Removal 10.1 Waste removal is included only if explicitly agreed in writing. 10.2 Excess, unexpected, or contaminated waste is chargeable. 11. Price Adjustments 11.1 Prices are fixed for the contract term unless: • The scope of work changes • Site conditions materially change 11.2 Any revised pricing takes effect immediately upon notification. 12. Liability & Risk 12.1 The company is not responsible for: • Pre-existing damage • Hidden or underground services • Fragile or poorly maintained structures 12.2 The customer accepts all risks associated with ground conditions and access limitations. 12.3 Claims must be submitted within 48 hours of service delivery or are deemed waived. 13. Right to Suspend or Terminate 13.1 The company may suspend or terminate services immediately if: • Payment terms are breached • The site is unsafe • The customer behaves unreasonably or abusively 13.2 Outstanding balances remain payable in full. 14. Force Majeure 14.1 The company is not liable for delays or failure to perform due to events beyond its control, including but not limited to weather, equipment failure, or staff illness. 14.2 Such delays do not entitle the customer to refunds or contract termination. 15. Entire Agreement 15.1 These Terms & Conditions constitute the entire agreement. 15.2 No verbal assurances override these Terms & Conditions. 15.3 Amendments must be made in writing by the company. 16. Governing Law 16.1 This agreement is governed by the laws of England and Wales.
